These Terms of Use (hereinafter referred to as the "Terms") set out the terms of use for the online store service (hereinafter referred to as the "Service") operated by the Katsushika Ward Traditional Industry Craftsmen's Association (hereinafter referred to as the "Association"). Please read these Terms carefully before using the Service.

Article 1 (Application)

  1. These Terms and Conditions shall apply to all relationships between the User and the Association regarding the use of the Service.
  2. In addition to these Terms and Conditions, the Association may make various other provisions regarding the Service, such as rules for use (hereinafter referred to as "Individual Provisions"). Regardless of their name, these Individual Provisions shall constitute part of these Terms and Conditions.
  3. If the provisions of these Terms and Conditions conflict with the individual provisions of the preceding Article, the provisions of the individual provisions shall take precedence unless otherwise specified in the individual provisions.

Article 2 (User Registration)

  1. For this service, registration will be completed when a person wishing to register agrees to these terms and conditions, applies for user registration in a manner specified by the Association, and the Association approves the application.
  2. If the Association determines that the applicant for user registration has any of the following reasons, the Association may not approve the application for user registration, and shall not be obligated to disclose the reasons therefor.
    1. If false information is submitted when applying for user registration
    2. If the application is from someone who has previously violated these Terms and Conditions
    3. Any other case in which the Association determines that registration is not appropriate.

Article 3 (Management of User ID and Password)

  1. Users shall be responsible for properly managing their user IDs and passwords for this service.
  2. Under no circumstances may a user transfer or lend their user ID and password to a third party, or share them with a third party. If a user ID and password combination matches the registered information and is used to log in, the Association will consider that the user ID is being used by the user who registered it.
  3. The Association shall not be liable for any damages arising from the use of a user ID and password by a third party, except in cases where the Association is guilty of willful misconduct or gross negligence.

Article 4 (Usage Fees and Payment Methods)

  1. In consideration of the use of this service, the user shall pay the usage fee separately determined by the Association and displayed on this website in the manner specified by the Association.
  2. If the User delays payment of the service fee, the User shall pay late payment charges at the rate of 14.6% per annum.

Article 5 (Prohibited matters)

When using this service, users must not engage in the following acts.

  1. Actions that violate laws and regulations or public order and morals
  2. Any activity related to criminal activity
  3. Any act of infringing the copyright, trademark, or other intellectual property rights contained in the content of this service, etc.
  4. Any act that destroys or interferes with the functioning of the servers or networks of the Association, other users, or other third parties.
  5. Commercially using information obtained through this service
  6. Any act that may interfere with the operation of our services
  7. Unauthorized access or attempted access
  8. Collecting or storing personal information about other users
  9. Using the Service for fraudulent purposes
  10. Any act that causes disadvantage, damage or discomfort to other users of the Service or other third parties.
  11. Impersonating other users
  12. Any publicity, advertising, solicitation, or sales activity on the Service that is not permitted by the Association.
  13. Acts aimed at meeting members of the opposite sex who are not acquainted with the person
  14. Any act of directly or indirectly providing benefits to anti-social forces in relation to the services of the Association
  15. Any other actions that the Association deems inappropriate

Article 6 (Suspension of provision of the Service, etc.)

  1. If the Company determines that any of the following circumstances exist, the Company may suspend or interrupt the provision of all or part of the Service without prior notice to the User.
    1. When performing maintenance, inspection, or updates to the computer system related to this service
    2. When it becomes difficult to provide the Service due to force majeure such as earthquake, lightning, fire, power outage or natural disaster.
    3. When a computer or communication line is stopped due to an accident
    4. Any other reason that the Association determines that it is difficult to provide the Service.
  2. The Association shall not be liable for any disadvantage or damage suffered by the User or any third party due to the suspension or interruption of the provision of the Service.

Article 7 (Usage Restrictions and Cancellation of Registration)

  1. If a User falls under any of the following, the Association may, without prior notice, restrict the User's use of all or part of the Service or cancel the User's registration.
    1. If you violate any of the provisions of these Terms and Conditions
    2. If it is discovered that any of the registered information is false
    3. If there is a default in payment obligations such as fees
    4. If there is no response to our contact for a certain period of time
    5. If the Service has not been used for a certain period of time since the last use
    6. Any other case in which the Association determines that use of the Service is inappropriate.
  2. The Association shall not be liable for any damages incurred by the User as a result of any actions taken by the Association pursuant to this Article.

Article 8 (Withdrawal)

Users may withdraw from this service by following the withdrawal procedures set forth by the Association.

Article 9 (Disclaimer of Warranties and Disclaimer)

  1. The Association makes no explicit or implicit guarantee that the Service is free from actual or legal defects (including defects related to safety, reliability, accuracy, completeness, validity, suitability for a particular purpose, security, etc., errors, bugs, infringement of rights, etc.).
  2. The Association shall not be liable for any damages incurred by the User as a result of the Service, except in cases where such damages are due to the Association's willful misconduct or gross negligence. However, this disclaimer shall not apply if the contract between the Association and the User regarding the Service (including these Terms and Conditions) constitutes a consumer contract as defined by the Consumer Contract Act.
  3. Even in the case of the proviso of the preceding paragraph, the Company shall not be liable for any damages incurred by the User due to default or tort caused by the Company's negligence (excluding gross negligence) that arise from special circumstances (including cases where the Company or the User foresaw or could have foreseen the occurrence of the damages). Furthermore, compensation for damages incurred by the User due to default or tort caused by the Company's negligence (excluding gross negligence) shall be limited to the amount of the usage fee received from the User in the month in which the damage occurred.
  4. The Association shall not be liable for any transactions, communications, or disputes that arise between users and other users or third parties in connection with the Service.

Article 10 (Changes to Service Content, etc.)

The Association may change, add or abolish the content of the Service with prior notice to the User, and the User shall agree to this.

Article 11 (Changes to Terms of Use)

  1. The Association may change these Terms and Conditions without obtaining the consent of individual users in the following cases:
    1. When changes to these Terms and Conditions are in the general interest of users.
    2. When the change to these Terms and Conditions does not contradict the purpose of the Service Agreement and is reasonable in light of the necessity of the change, the appropriateness of the content after the change, and other circumstances related to the change.
  2. When changing these Terms and Conditions pursuant to the preceding paragraph, the Association will notify the User in advance of the fact that these Terms and Conditions will be changed, the content of the changed Terms and Conditions, and the date when they will come into effect.

Article 12 (Handling of Personal Information)

The Association will handle personal information obtained through the use of this service appropriately in accordance with its "Privacy Policy."

Article 13 (Notification or Contact)

Any notice or communication between the user and the Association shall be made in the manner specified by the Association. Unless the user notifies the Association of a change in accordance with the method separately specified by the Association, the Association will consider the currently registered contact information to be valid and will notify or contact the user at that contact information, and these will be deemed to have reached the user at the time of sending.

Article 14 (Prohibition of Transfer of Rights and Obligations)

Users may not transfer or pledge to a third party their status under the Terms of Use or their rights or obligations under these Terms of Use without the prior written consent of the Association.

Article 15 (Governing Law and Jurisdiction)

  1. The interpretation of these Terms and Conditions shall be governed by Japanese law.
  2. In the event of a dispute arising in relation to this service, the court with jurisdiction over the location of the head office of the Association shall have exclusive jurisdiction.
